1. Acceptance of Terms
By accessing, browsing, or purchasing from the Jasmine Bags website (the "Site"), you ("Customer," "you," or "your") agree to be legally bound by these Terms of Service ("Terms"), including all policies incorporated herein by reference, such as our Privacy Policy, Shipping Policy, and Return Policy. If you do not agree to these Terms in their entirety, you must immediately cease use of this Site and refrain from placing any order.
These Terms constitute a legally binding agreement between you and Jasmine Bags ("Company," "we," "us," or "our"). Your continued use of the Site or completion of a purchase constitutes your unconditional acceptance of these Terms as they exist at the time of each transaction.
2. Eligibility
You represent and warrant that: (a) you are at least 18 years of age or the age of legal majority in your jurisdiction; (b) you have the legal capacity to enter into binding contracts; (c) you are not prohibited from receiving products under applicable law; and (d) all information you provide is accurate, current, and complete.
Use of the Site by persons under 18 is not authorized without verifiable parental or guardian consent.
3. Products and Product Description
3.1 Product Offered
Jasmine Bags offers for sale the following product: a mini cowboy hat-shaped backpack in brown suede, featuring an adjustable cow-print strap and a zippered compartment designed to carry everyday essentials (the "Product").
3.2 Manufacturing Disclosure — Important Notice
Due to high demand, products that were previously crafted by hand (handmade) have transitioned to production in industrial manufacturing facilities.
By communicating this transition within these Terms of Service, Jasmine Bags shall bear no liability for any claim, dispute, chargeback, or demand based on any expectation of handmade or artisanal product characteristics. The Customer, by completing a purchase, expressly acknowledges and accepts this condition. No representations, advertisements, social media posts, or third-party descriptions referencing handmade or artisanal qualities shall constitute a warranty or condition of sale for units manufactured after the date of this notice.
3.3 Product Accuracy
We make reasonable efforts to display product colors, textures, and dimensions accurately. However, due to variations in monitor settings, screen resolution, and individual device calibration, actual product appearance may differ from images displayed on the Site. Such variation does not constitute a defect, misrepresentation, or grounds for return outside the conditions stated in Section 7.
3.4 Availability
All products are offered subject to availability. We reserve the right, without prior notice, to limit order quantities, discontinue any product, or refuse service to any customer at our sole discretion. Listing a product on the Site does not constitute a guarantee of availability.
4. Pricing and Payment
4.1 Pricing
All prices are displayed in U.S. dollars (USD) and are subject to change without notice. The price applicable to your order is the price displayed at the time you complete checkout. We are not responsible for pricing errors and reserve the right to cancel any order placed at an incorrect price.
4.2 Taxes
You are responsible for all applicable sales taxes, use taxes, duties, and other governmental charges associated with your purchase. Applicable taxes will be calculated and displayed at checkout to the extent required by law.
4.3 Payment Authorization
By submitting an order, you represent that you are authorized to use the payment method provided. We reserve the right to verify payment information and to cancel or hold orders pending verification. Fraudulent payment may be reported to appropriate law enforcement authorities.
4.4 Currency and Charges
All transactions are processed in USD. If your financial institution operates in a different currency, foreign exchange rates and any associated conversion fees are solely your responsibility.
5. Order Processing and Fulfillment
5.1 Order Confirmation
Submission of an order constitutes an offer to purchase. An order is not accepted until you receive an explicit order confirmation from us via email. We reserve the right to reject any order for any reason, including but not limited to product unavailability, suspected fraud, or errors in pricing or product description.
5.2 Processing Time
All orders require 1 to 3 business days of processing time before shipment. Business days are Monday through Friday, excluding U.S. federal holidays. Processing begins upon successful payment authorization, not upon order submission.
5.3 Shipping and Delivery Window
Following completion of processing, estimated delivery is 13 to 20 business days. Total fulfillment time (processing plus shipping) is therefore approximately 14 to 23 business days from the date of payment authorization.
All delivery timeframes are estimates only and are not guaranteed. Jasmine Bags shall bear no liability for delays caused by carriers, customs authorities, weather events, Acts of God, labor disputes, pandemics, governmental actions, or any other circumstances beyond our reasonable control.
5.4 Shipping Costs
Shipping costs, if any, are displayed at checkout and are non-refundable under all circumstances, including order cancellation, return, or refusal of delivery.
5.5 Shipping Destination
We currently ship to addresses within the United States. We reserve the right to restrict shipping to certain locations at our sole discretion.
5.6 Risk of Loss
Title and risk of loss for all products pass to you upon our delivery of the Product to the carrier. We are not responsible for lost, stolen, or damaged packages after carrier acceptance. You are responsible for filing any applicable carrier claims.
6. Order Cancellation
6.1 Cancellation Before Shipment
You may request cancellation of an order only during the processing window (Section 5.2), provided the order has not yet been dispatched to the carrier. To request cancellation, you must contact us immediately at jasmine.makesartt@gmail.com with your order number and cancellation request.
6.2 No Cancellation After Shipment
Once an order has been handed to a carrier and a tracking number has been generated, the order cannot be cancelled under any circumstances. No exceptions will be made regardless of the reason for the cancellation request, including but not limited to shipping delays, change of mind, or failure to receive within the estimated window.
6.3 Logistics Delays Do Not Constitute Grounds for Cancellation
Delays within the published shipping window, or delays caused by carrier events, customs processing, or any other logistical factors, do not entitle the Customer to order cancellation, partial or full refund, or any other remedy beyond what is expressly provided in these Terms.
7. Return and Refund Policy
7.1 Return Eligibility Window
Returns are accepted within 90 days of the date of delivery confirmation, as recorded by the carrier's tracking system. Requests submitted after the 90-day window will be denied without exception.
7.2 Strict Condition Requirements
To be eligible for return, the Product must meet all of the following conditions, without exception:
- The Product must be completely unused and unopened
- All original factory seals and packaging must be fully intact and untampered
- The Product must show no signs of handling, use, wear, alteration, washing, odor, or any form of manipulation
- All original tags, labels, inserts, and accessories must be included
- The Product must be in the same condition as delivered
Failure to satisfy any single condition renders the return ineligible. We reserve the right to make the sole and final determination as to whether return conditions have been met.
7.3 Non-Returnable and Excluded Items
The following are expressly excluded from our return and refund policy:
- Products showing any signs of use, wear, or manipulation
- Products with removed, altered, or damaged packaging or seals
- Products damaged after delivery due to customer mishandling
- Products returned without prior written authorization from Jasmine Bags
- Items purchased during promotional, clearance, or final-sale events, if designated as such at time of purchase
- Requests based solely on change of mind after the product has been opened or handled
- Claims based on dissatisfaction with manufacturing method, including expectations of handmade or artisanal production (see Section 3.2)
- Shipping delays that fall within or outside the published delivery window
7.4 Return Shipping Costs
All return shipping costs are the sole responsibility of the Customer. Jasmine Bags will not issue prepaid return labels, reimburse return postage, or bear any portion of return shipping expenses under any circumstances. We strongly recommend using a trackable, insured shipping method, as we are not responsible for return packages lost or damaged in transit.
7.5 Return Authorization Requirement
No return will be accepted without prior written authorization. To initiate a return, contact jasmine.makesartt@gmail.com with: (a) your full name; (b) order number; (c) date of delivery; (d) reason for return; and (e) photographic evidence of the product in its unopened, sealed condition.
We will review your request and respond within a commercially reasonable time. Sending a product back without authorization will result in denial of any refund.
7.6 Inspection and Refund Processing
Upon receipt of an authorized return, the Product will undergo a complete physical inspection to verify compliance with the conditions set forth in Section 7.2. This inspection process may take up to 14 business days from the date of receipt of the returned item. We will notify you by email of the inspection outcome.
If the return is approved, a refund will be issued to your original payment method. Please allow an additional 5 to 10 business days for the refund to be reflected in your account, depending on your financial institution's processing times. Jasmine Bags is not responsible for delays attributable to your bank or payment processor.
If the return is denied following inspection, you will be notified by email. In such case, the Product may be shipped back to you at your expense or disposed of if return shipping is not arranged within 14 calendar days of notification.
7.7 Original Shipping Costs Are Non-Refundable
Under no circumstances will original shipping charges be refunded, whether or not the return is approved. The refund, if granted, applies solely to the purchase price of the Product.
7.8 Chargebacks and Payment Disputes
Filing a chargeback or payment dispute with your financial institution without first following the return and resolution process set forth in these Terms constitutes a breach of this agreement. We reserve all rights to challenge such chargebacks and to provide these Terms, order records, and communications as evidence to the relevant payment processor or financial institution.
8. Warranty
8.1 Limited Warranty
Jasmine Bags warrants that the Product will be free from material defects in materials and workmanship for a period of 90 days from the date of delivery. This limited warranty is your sole and exclusive warranty and replaces all other warranties.
8.2 Warranty Exclusions
This warranty does not cover: (a) damage resulting from misuse, accident, neglect, or unauthorized modification; (b) normal wear and tear; (c) damage caused by failure to follow care instructions; (d) cosmetic damage that does not affect function; (e) defects arising from handmade or artisanal production expectations (see Section 3.2); or (f) any damage occurring after the 90-day warranty period.
8.3 Disclaimer of Additional Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JASMINE BAGS EXPRESSLY DISCLAIMS ALL WARRANTIES NOT STATED HEREIN, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, JASMINE BAGS, ITS OWNERS, OPERATORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO ANY SINGLE ORDER EXCEED THE AMOUNT ACTUALLY PAID BY YOU FOR THE PRODUCT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, the above limitations apply to the fullest extent permitted by law.
10. Governing Law and Dispute Resolution
10.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to conflict of law principles.
10.2 Informal Resolution
Before initiating any formal dispute, you agree to first contact us at jasmine.makesartt@gmail.com and provide a written description of the dispute, your desired resolution, and relevant documentation. We will attempt to resolve the dispute informally within 30 days of receipt of your notice.
10.3 Binding Arbitration
If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms or your purchase shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. You waive your right to a jury trial and your right to participate in a class action.
10.4 Class Action Waiver
ALL CLAIMS MUST BE BROUGHT IN THE PARTIES' INDIVIDUAL CAPACITIES AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. This waiver is an essential element of this agreement; if it is found unenforceable, the entire arbitration provision shall be void.
10.5 Exception for Small Claims
Either party may bring an individual claim in small claims court in lieu of arbitration, provided the claim qualifies and remains on an individual basis.
11. Intellectual Property
All content on this Site, including but not limited to brand name, logo, product descriptions, photographs, and graphics, is the property of Jasmine Bags or its licensors and is protected by applicable U.S. and international intellectual property laws. You may not reproduce, distribute, modify, or otherwise exploit any content without our prior written consent.
12. Prohibited Conduct
You agree not to: (a) use the Site for any unlawful purpose; (b) submit false, misleading, or fraudulent information; (c) attempt to gain unauthorized access to any portion of the Site; (d) engage in conduct that disrupts or interferes with Site operations; (e) use automated tools, bots, or scrapers to access or collect data from the Site; or (f) resell products purchased from the Site without our express written authorization.
13. Privacy
Your use of the Site is also governed by our Privacy Policy, the terms of which are incorporated herein by reference. By using the Site, you consent to the collection and use of your information as described in our Privacy Policy.
14. Modifications to Terms
We reserve the right to modify these Terms at any time at our sole discretion. Changes will be effective upon posting to the Site with an updated "Last Updated" date. Your continued use of the Site or placement of an order following such posting constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
15. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, without affecting the validity or enforceability of the remaining provisions.
16. Entire Agreement
These Terms, together with our Privacy Policy, Shipping Policy, and Return Policy as published on the Site, constitute the entire agreement between you and Jasmine Bags with respect to your use of the Site and purchase of products, and supersede all prior or contemporaneous communications, representations, or agreements, whether written or oral.
